Daniel Sylvester

Message from Del Norte to Humboldt- Attorney General Investigate Killing by Police?

The District Attorney can request the California Attorney General's office to do the investigation into Robert Garth's death .* In the Daniel Sylvester taser execution in Del Norte, DA Riese requested the AG conduct the investigation. This has at least provided the appearance of more impartiality.

*Not sure what sort of pressure would be needed on Gallegos to request the outside investigation; not sure how much better an AG investigation is (the only satisfaction we got from it in Del Norte was that there are permanent records at the state level and that Del Norte had to squirm a bit. Still, that's something.). The only benefits I can see for pushing for external investigations is that the AG's office may eventually become so tired of doing them, stronger local internal oversight policies may be imposed and "shoot-first" behavior may be reduced, if they think they'll have to answer to DOJ agents.

Daniel Sylvester Was Tased to Death by Cops after he backed away saying "Leave me alone, I am scared."

l spoke to Daniel (tasered man)'s Mom.  She said when the cops arrived Daniel was outside, calm at the time... The cops said something and Daniel said "Leave me alone," and backed away from the cops saying "Leave me alone, I am scared."

The cops had no reason to draw the taser at all at this point. The cops follow Daniel into his home with taser drawn and started tasing. Mom said Daniel did not attack the cops..... Who knows what fiasco started after the tasing begain... It turns into a frenzy by the cops....

Thank God there are witnesses to this. There needs to be training in de-escalation.. instead they escalate situations...Daniel Sylvester did not need to die,, deserve to die.. The family did not deserve this grief.
Mom will be ready to speak out soon.

MESSAGE: from Redwood Curtain CopWatcher to Del Norte WatchDog- Regarding Cop with Taser Killing of (unarmed) Man in Crescent City, June 22, 2010

Lenda,
Please encourage the family to request an independent autopsy and for the body to be PRESERVED.

When the system tells a grieving family that they have 'this' many days to cremate or bury, the grieving family usually does it quick and has to rally together the money to pay for it.  PLEASE tell them that they are entitled, if they request and notice the coroner, to an independent forensics testing (not sure how to pay for it, but it would be a forensic pathologist that the family chooses) and that should halt the "destruction" of Daniel's body.

Also, they should work on not allowing the body to be destroyed so that if or when they sue , there is a body to examine.  OFTEN, the coroner's reports (including toxicology) do NOT match up with 1) the injuries that parents have seen on their dead children's bodies and 2) the substances that persons had in them prior to death (i.e. nicotine, marijuana)
